Velvet Edge Travel Ltd Booking Conditions

The following Booking Conditions, together with the Velvet Edge Travel Ltd privacy policy and any Important Information provided with your quotation, itinerary or booking confirmation, form the basis of the contract between Velvet Edge Travel Ltd ("Velvet Edge Travel", "we", "us" or "our") and the lead passenger and all other persons named on the booking (together, "you" and "your"). These Booking Conditions apply to holidays, travel arrangements and related services arranged, sold or facilitated by Velvet Edge Travel Ltd.
Please read these Booking Conditions carefully before confirming a booking, because they set out the respective rights and obligations of both you and Velvet Edge Travel Ltd.
- Company details
Velvet Edge Travel Ltd is a company incorporated in England and Wales under company number 17079658.
Where Velvet Edge Travel Ltd arranges or sells travel under the InteleTravel framework, references to ABTA and ATOL protection are made on the basis that bookings may be processed through or under the authority of InteleTravel, whose details must be checked on the relevant booking confirmation and ATOL Certificate.
The ABTA number to be displayed for applicable bookings is P7384 and the ATOL number to be displayed for applicable flight-inclusive bookings is 12022, which can be verified through the Civil Aviation Authority ATOL checker by searching for InteleTravel or ATOL number 12022.
Important clarification: references on this website or in these Booking Conditions to ABTA membership number P7384 and ATOL number 12022 apply only where your booking is made through Velvet Edge Travel Ltd as an affiliated or appointed travel business operating under InteleTravel’s authorised arrangements and only to the extent confirmed in your booking documentation, invoice and any ATOL Certificate issued to you.
- Your contract
A contract exists only when Velvet Edge Travel Ltd has accepted your booking, received any required payment and issued a booking confirmation or confirmation invoice.
The lead passenger must be at least 18 years old and is deemed to accept these Booking Conditions on behalf of all persons named on the booking, including any minors for whom they are authorised to act.
The lead passenger is responsible for ensuring that all names, dates of birth, passport details and other travel information supplied to Velvet Edge Travel Ltd are accurate and match the relevant travel documents exactly.
- Package and non-package bookings
Where you book a package holiday within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018, you will benefit from the rights that apply to package travel and Velvet Edge Travel Ltd will be responsible for the proper performance of the package as a whole, subject to these Booking Conditions and applicable law.
Where you arrange a non-package booking, or where Velvet Edge Travel Ltd acts only as agent for airlines, hotels, tour operators, transfer providers, cruise lines or other suppliers, your contract for those travel services may be directly with the relevant supplier and the supplier’s own terms and conditions will apply.
For non-package arrangements, Velvet Edge Travel Ltd is not responsible for the performance of services provided by third-party suppliers except to the extent required by law or where loss is caused by our failure to exercise reasonable skill and care in arranging the booking.
- Quotes, pricing and availability
All quotations are subject to availability and are not binding until the booking has been confirmed by Velvet Edge Travel Ltd in writing.
Prices may change before confirmation due to supplier availability, exchange rate movements, taxes, surcharges, airline pricing, hotel pricing or other factors outside our control.
Velvet Edge Travel Ltd reserves the right to correct pricing errors or obvious mistakes before or after a quotation is issued and, where permitted by law, before a binding contract is formed.
- Payment terms
A deposit or such other payment as specified in your quotation or booking confirmation must be paid at the time of booking.
In some cases, including but not limited to certain airfare types, special offers, luxury villas, bespoke itineraries or supplier-imposed conditions, full payment or a higher non-refundable deposit may be required at the time of booking.
The balance must be paid by the date shown on your confirmation invoice. If payment is not received on time, Velvet Edge Travel Ltd may treat the booking as cancelled by you and apply the relevant cancellation charges.
- Refund policy
Refunds are not automatic and are only available where the underlying airline, hotel, resort, cruise line, tour operator, transport provider, destination management company or any other relevant supplier permits a refund under its own booking conditions.
Velvet Edge Travel Ltd does not independently guarantee any refund unless expressly stated in writing in your quotation, booking confirmation or other written communication issued by Velvet Edge Travel Ltd.
The refund conditions applicable to your booking will be disclosed to you at the time a quotation is officially prepared, at the time of booking, or both, and may include supplier-specific cancellation scales, non-refundable deposits, amendment penalties, airline fare rules, administrative charges, payment processing charges and other third-party costs.
By proceeding with a booking, you acknowledge and agree that:
- refund entitlement depends entirely on the terms of the relevant supplier or suppliers for each travel component;
- some bookings, fares, accommodation rates, packages or services may be wholly non-refundable from the time of confirmation;
- some suppliers may permit only partial refunds or may apply cancellation fees up to 100% of the booking value;
- any refund processing time will depend on when funds are received back from the relevant supplier; and
- any service, planning, consultation or administration fees charged by Velvet Edge Travel Ltd may be non-refundable unless stated otherwise in writing.
Where a supplier approves a refund, Velvet Edge Travel Ltd will use reasonable efforts to facilitate the refund to you, less any non-refundable fees, charges or deductions that lawfully apply.
If a supplier refuses a refund, delays a refund or pays only a partial refund, Velvet Edge Travel Ltd shall not be liable for any amount beyond what it actually recovers from the supplier for your booking, unless liability arises under applicable consumer law and cannot lawfully be excluded.
- Amendments and transfers by you
If you wish to amend a confirmed booking, the lead passenger must notify Velvet Edge Travel Ltd in writing as soon as possible.
Any amendment is subject to availability and acceptance by the relevant supplier or suppliers, and may incur supplier charges, fare increases, reissue costs and an administration fee charged by Velvet Edge Travel Ltd.
Where a transfer of the booking to another person is legally permitted and operationally possible, Velvet Edge Travel Ltd may allow the transfer subject to supplier approval, payment of all related costs and compliance with applicable legal requirements.
- Cancellation by you
If you wish to cancel a booking, the lead passenger must notify Velvet Edge Travel Ltd in writing.
Cancellation takes effect from the date written notice is received by Velvet Edge Travel Ltd.
Unless otherwise stated in writing, cancellation charges, refund eligibility and any retained sums will be determined by the supplier terms disclosed for your booking at quotation stage, booking stage or both.
Where a schedule of cancellation charges is supplied with your quotation or confirmation, that schedule will form part of your contract and apply in addition to any non-refundable elements already committed to suppliers.
- Cancellation or changes by us
Occasionally Velvet Edge Travel Ltd may need to make changes to your arrangements or cancel a booking before or after confirmation because of supplier changes, operational reasons, minimum number requirements, legal or regulatory issues, force majeure, pricing errors or other circumstances outside our reasonable control.
Where a significant change or cancellation arises after confirmation and the booking is a package booking, Velvet Edge Travel Ltd will offer the remedies required by applicable law, which may include acceptance of the change, an alternative arrangement where available, or a refund.
No compensation will be payable where a change or cancellation results from unavoidable and extraordinary circumstances, insufficient participation where lawfully disclosed, or your own failure to comply with the booking terms.
- Financial protection and ATOL
Where your booking includes a flight and is sold in circumstances where ATOL protection applies, you should receive an ATOL Certificate setting out what is financially protected, who is providing that protection and who to contact if there is a problem.
Velvet Edge Travel Ltd may state that applicable bookings are made under ATOL number 12022 and ABTA number P7384 where those protections are provided through InteleTravel’s authorised arrangements, but the existence and scope of any protection will always be determined by the booking documentation actually issued to you, including any ATOL Certificate.
You should not rely solely on website wording; you should check your confirmation, invoice and ATOL Certificate carefully and verify ATOL protection directly through the Civil Aviation Authority’s ATOL checking service.
- Insurance
Adequate travel insurance is strongly recommended and may be required as a condition of booking for certain trips, destinations or activities.
Your policy should cover at least cancellation, medical expenses, repatriation, personal liability and any specialist activities included in your itinerary.
Velvet Edge Travel Ltd accepts no responsibility for losses that would otherwise have been covered under an appropriate insurance policy where you fail to obtain suitable cover.
- Passports, visas and health requirements
You are responsible for ensuring that all travellers hold valid passports, visas, vaccination records, health certificates and other required documentation for the destination, transit points and return journey.
Any general information provided by Velvet Edge Travel Ltd is for guidance only and may change without notice.
Velvet Edge Travel Ltd will not be liable if you are refused travel, entry, boarding or onward passage because you do not hold the correct documents or have not met health or immigration requirements.
- Supplier terms and conditions
Velvet Edge Travel Ltd arranges travel services supplied by third parties including airlines, hotels, villas, transfer companies, tour operators, cruise providers and destination service companies, and all such arrangements are subject to the terms and conditions of those suppliers.
Those supplier terms may limit or exclude liability, impose strict payment and cancellation conditions, require waivers, limit baggage allowances, restrict refunds and impose operational rules beyond Velvet Edge Travel Ltd’s control.
By confirming a booking, you agree to be bound by the relevant supplier terms for each travel component.
- Liability
Nothing in these Booking Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under English law.
Subject to the above, and to the extent permitted by law, Velvet Edge Travel Ltd shall not be liable for losses arising from the acts or omissions of third-party suppliers, force majeure, events outside our reasonable control, your own acts or omissions, or matters not forming part of the contracted travel arrangements.
For non-package bookings, liability is limited to circumstances in which Velvet Edge Travel Ltd has failed to exercise reasonable skill and care in arranging the relevant service.
- Behaviour and damage
You are responsible for any damage, loss, extra cleaning, fines, penalties or other costs caused by your acts or omissions or those of any member of your party.
Velvet Edge Travel Ltd and any supplier reserve the right to refuse or terminate travel arrangements without refund if, in the reasonable opinion of Velvet Edge Travel Ltd or the supplier, your behaviour is disruptive, abusive, unsafe, unlawful or likely to cause damage, distress or danger.
- Flights, schedules and carriers
Flight times, carriers, aircraft types, routings and schedules are subject to change by airlines and airports, sometimes at short notice.
You must check all travel documents immediately upon receipt and notify Velvet Edge Travel Ltd promptly if anything appears incorrect.
You are also responsible for complying with airline check-in, reconfirmation, baggage, seating and ticket usage rules, including any rule that failure to use the outbound sector may invalidate the return sector.
- Delays and denied boarding
Where flights are delayed, cancelled or boarding is denied, your rights may lie primarily against the airline under applicable air passenger rights legislation and airline conditions of carriage.
Any reimbursement, assistance or compensation payable in those circumstances may be the responsibility of the airline rather than Velvet Edge Travel Ltd.
- Complaints and assistance
If you encounter a problem during your trip, you must notify the relevant supplier and Velvet Edge Travel Ltd as soon as possible so that reasonable steps can be taken to assist and, where possible, resolve the issue during travel.
If the matter is not resolved during travel, any complaint should be submitted in writing within 28 days of return, together with your booking reference and supporting evidence.
Failure to raise a complaint promptly may reduce or extinguish any entitlement to compensation where investigation or remedy has been prejudiced.
- Force majeure
Velvet Edge Travel Ltd shall not be liable for any failure or delay in performing its obligations where performance is prevented or affected by unavoidable and extraordinary circumstances beyond its reasonable control, including but not limited to war, threat of war, civil unrest, terrorism, industrial disputes, pandemic, epidemic, government restrictions, border closures, severe weather, natural disaster, airport closure, airspace restrictions, supplier insolvency events outside our control, or other force majeure events.
Where legally required for package bookings, Velvet Edge Travel Ltd will provide such remedies or assistance as the law mandates in cases of unavoidable and extraordinary circumstances.
- Website accuracy
Velvet Edge Travel Ltd takes reasonable care to ensure that information on its website, marketing materials and itineraries is accurate at the time of publication, but errors and changes may occur.
Images are illustrative unless specifically stated otherwise, and facilities, services and local conditions may change after publication.
- Data protection and privacy
Velvet Edge Travel Ltd will process personal data in accordance with applicable UK data protection law and its privacy policy.
Personal data may need to be shared with airlines, hotels, operators, insurers, payment processors, overseas suppliers and public authorities where necessary to arrange or administer your travel.
- Governing law and jurisdiction
These Booking Conditions and any contract to which they apply are governed by the laws of England and Wales.
Any dispute or claim arising out of or in connection with these Booking Conditions or any booking shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer law provides otherwise.
